What a co-borrower agreement does

Where two people take a loan together, this settles between them who pays what. The bank can pursue either of you for the whole debt regardless — this agreement decides how you settle up with each other.

In Sweden this document is called Medlåntagaravtal. It is worth learning the Swedish term: it is what a bank, a housing association, an employer or an authority will ask you for, and searching for the English name alone will often turn up rules from another country that do not apply here. The rules come from The Promissory Notes Act, skuldebrevslagen (1936:81), and the questions you answer while creating the document are the ones that statute makes relevant.

When you need one

  • You are taking a mortgage together but paying different shares.
  • You are a co-borrower on someone else's loan.
  • You want a right of recourse if you end up paying more than your share.
