How to choose in family & relationships

Start by identifying whether the question concerns cohabitation, marriage, children or separation. Then decide whether you need to document ownership, plan for a future event or record an arrangement that is already being carried out.

Questions to answer before you start

Who must be a party to the document, and what is each person's role?
What property, responsibility or future event needs to be covered?
Does one document solve the whole question, or do separate documents deal with different parts?

When a standard document may not be enough: If the parties disagree, assets are located in more than one country or ownership is unclear, ask for individual advice before relying on a standard document.

Prenuptial agreement

Swedish: Äktenskapsförord

A marital property agreement (äktenskapsförord) makes named assets private property, so they are left out of the division if you divorce or one of you dies. It must be registered with the Swedish Tax Agency to be valid.

The document that formally divides your assets when a marriage or a cohabiting relationship ends. Banks require it before they will move a mortgage, and without it either party can reopen the division years later.

Swedish: Skilsmässoansökan

The application to the Swedish district court that begins a divorce. It covers whether you apply jointly or alone, any children under 16, and whether a six-month reconsideration period applies before the divorce can be granted.

Swedish: Underhållsbidragsavtal

A written agreement on how much maintenance one parent pays for a child, when it is paid and how it is adjusted. A written agreement is what Försäkringskassan and, if it ever comes to it, the enforcement authority will look at.

Written terms between a family who needs care and the relative providing it: hours, tasks, compensation, holidays and how either side ends the arrangement. It turns an unspoken expectation into something both sides have agreed.

Pet custody agreement

Swedish: Husdjursavtal

Decides who keeps the animal if you separate, and who pays for food, insurance and vet bills. Swedish law treats a pet as property, so without an agreement it goes to whoever can prove ownership, not to whoever cares for it.

Revocation of a prenuptial agreement

Swedish: Upphävande av äktenskapsförord

Cancels an existing äktenskapsförord so that your property becomes marital property again. Like the original, the revocation only takes effect once it has been registered with the Swedish Tax Agency.

Custody, residence and contact agreement

Swedish: Vårdnads-, boende- och umgängesavtal

Covers legal custody, where the child lives and how contact with the other parent works. Once approved by the social welfare committee it is legally binding and enforceable in the same way as a court judgment.

Parental consent for travel

Written consent from the guardian who is not travelling. Swedish law does not require the letter itself, but with joint custody both guardians decide together — and border control, airlines and destination countries routinely ask for the proof.

Division of property during marriage

Swedish: Bodelning under äktenskap

Spouses can divide their property without divorcing. The order matters: a written notice goes to Skatteverket first and is registered there, and only then is the division itself carried out and signed by both. Done in the wrong order it has no effect between you.

Nomination of a guardian for your children

Swedish: Vårdnadstestamente

Names the person you want the court to appoint as your children's guardian if both parents die. It is not a will and it binds no one, but the court must appoint the person you name unless doing so would be unsuitable, and the social welfare committee is heard before the court decides.

Statement of living apart while married

Swedish: Särlevnadsintyg

Swedish law presumes that spouses live together, and you have to prove otherwise. This sets out the separation date, both addresses, the Skatteverket registration, overnight stays, your housing papers and how the finances split, with room for outside witnesses. It does not end the marriage, and the authority still decides.
