First identify the type of property and whether you are renting, subletting, buying, selling or sharing ownership. Agreements with similar names may be designed for different objects and different roles.

Questions to answer before you start

  • What exactly is the property or right that the document concerns?
  • Who owns, rents, buys, sells or uses it, and from what date?
  • Which payment, condition, handover or shared-cost questions need to be recorded?

When a standard document may not be enough: If ownership, permission to let, defects or an existing dispute are unclear, establish those facts before choosing a standard agreement.

Lets someone use part of your property — a track, a jetty, parking, hunting, a pipe — without transferring ownership. Unlike an easement it is personal, so it does not automatically survive a sale of the property.

Notice to terminate a lease

Written notice is required once the tenancy has lasted more than three months, and it must be formally served on the other party. A notice that was posted but cannot be proved received is close to worthless in a dispute, which is why this one comes with an acknowledgement of receipt.

For building, extension, renovation or installation work: the scope, the price, the dates, inspection and who answers for defects. If the client is a consumer, the Consumer Services Act sets a floor no clause can go below; between two businesses only the contract does.
