What a mutual will does

One will made by two people together, deciding how you inherit from each other and who receives what is left when you have both died. The standard choice for couples, and the only way cohabiting partners can inherit from each other.

In Sweden this document is called Gemensamt testamente. It is worth learning the Swedish term: it is what a bank, a housing association, an employer or an authority will ask you for, and searching for the English name alone will often turn up rules from another country that do not apply here. The rules come from The Inheritance Code, Ärvdabalken (1958:637), and the questions you answer while creating the document are the ones that statute makes relevant.

When you need one

  • You are cohabiting, so neither of you inherits from the other by law.
  • You are married with children from previous relationships.
  • You want to decide together who the final beneficiaries are.

Will the mutual will be in Swedish or English?

The finished document is in Swedish. That is deliberate: a Swedish mutual will is read by Swedish counterparties, banks, authorities and, if it ever comes to it, a Swedish court, and a translation has no legal standing on its own. Which law applies to a mutual will in Sweden?

The Inheritance Code, Ärvdabalken (1958:637). The template follows it, and the questions you answer are the ones that statute makes relevant. Swedish law is what governs the document regardless of where you are from or where you signed it.

Is it valid if I am not a Swedish citizen?

Yes. What matters for a mutual will is Swedish law and the connection to Sweden, not your citizenship. You do not need a Swedish personal identity number to create the document, and you do not need Swedish BankID to sign it, because e-signing works with email verification as well.

What does it cost?

What if it turns out to be wrong for my situation?

Tell us and we will correct it at no cost. If a document does not fit your circumstances, the honest answer is sometimes that you need advice rather than a template, and we will say so — you can book a lawyer instead of buying the document.

Who can witness it?

Two people aged 15 or over who are present at the same time, who understand that they are witnessing a will, and who are independent of it. Nobody who inherits under the will, and no close relative of anyone who does, may witness. Getting this wrong is the single most common reason a Swedish will fails.
