What a redundancy dismissal notice does

Written notice of dismissal for redundancy. The part most templates get wrong is the fullföljdshänvisning: the notice must state how the employee challenges the dismissal, how to claim damages, and whether there is priority for re-employment. Leave one out and the two-week deadline becomes a month.

In Sweden this document is called Uppsägning på grund av arbetsbrist. It is worth learning the Swedish term: it is what a bank, a housing association, an employer or an authority will ask you for, and searching for the English name alone will often turn up rules from another country that do not apply here. The rules come from The Employment Protection Act, lagen om anställningsskydd (1982:80), 7, 8, 22 and 25 §§, and the Co-Determination Act, medbestämmandelagen (1976:580), 11 and 15 §§, and the questions you answer while creating the document are the ones that statute makes relevant.

When you need one

  • Orders, revenue or funding have fallen and one or more positions have to go.
  • You run a small company without a collective agreement and need to know what must be done before the notice may be handed over.
  • Union negotiation is closed and the selection order is set, and the notice now has to meet the form requirements in 8 § LAS.

How it works

Under section 10 of the Employment Protection Act (1982:80) a notice of termination must be handed to the employee in person, and may be sent by registered letter only where that is not reasonable. Notice is deemed given when the employee receives it, so delivery is part of the act itself and an electronic signature on the employer's side does not prove receipt.

Being straight about language: this page, the guides and our support are in English. Will the redundancy dismissal notice be in Swedish or English?
