What a mutual termination agreement does
An agreement to end employment by consent, instead of by dismissal. The point most templates skip: leaving voluntarily can be treated as leaving without valid reason, which suspends unemployment benefit for 45 compensation days. The agreement should record who took the initiative and why.
In Sweden this document is called Uppsägningsavtal. It is worth learning the Swedish term: it is what a bank, a housing association, an employer or an authority will ask you for, and searching for the English name alone will often turn up rules from another country that do not apply here. The rules come from The Employment Protection Act, LAS 1982:80, 11 §, and the Unemployment Insurance Act 2024:506, 7 kap. 4 §, and the questions you answer while creating the document are the ones that statute makes relevant.
When you need one
- Employer and employee both want a clean end without a dismissal process.
- A severance payment, garden leave or reference is part of the deal.
- You need a final settlement so neither side comes back with claims later.
