What a division of property agreement does

The document that formally divides your assets when a marriage or a cohabiting relationship ends. Banks require it before they will move a mortgage, and without it either party can reopen the division years later.

In Sweden this document is called Bodelningsavtal. It is worth learning the Swedish term: it is what a bank, a housing association, an employer or an authority will ask you for, and searching for the English name alone will often turn up rules from another country that do not apply here. The rules come from The Marriage Code, Äktenskapsbalken (1987:230), and the questions you answer while creating the document are the ones that statute makes relevant.

When you need one

  • You have divorced or separated and need to take one name off a mortgage.
  • You want the split to be final and impossible to reopen later.
  • You are dividing property while still married, which Swedish law allows.
