What a power of attorney for banking does

Lets a named person deal with your Swedish bank while you can still decide for yourself: paying bills, cash withdrawals, an amount limit per transaction and an end date. Property, gifts and guarantees are excluded in writing, and each bank decides whether it accepts an outside document.

In Sweden this document is called Bankfullmakt. It is worth learning the Swedish term: it is what a bank, a housing association, an employer or an authority will ask you for, and searching for the English name alone will often turn up rules from another country that do not apply here. The rules come from The Contracts Act, avtalslagen (1915:218), 2 kap. 10, 11, 16 and 21 §§, and the questions you answer while creating the document are the ones that statute makes relevant.

When you need one

  • You are in hospital or abroad and someone at home must keep your Swedish bills paid.
  • A parent wants an adult child to handle payments, but with a written limit and an end date.
  • The bank has asked for written authorisation before your representative visits a branch.

If none of these quite describes your situation, that is worth taking seriously rather than working around. Ask us in English and we will tell you honestly whether this is the right document, a different one, or a case that needs advice instead of a template.

How it works

  1. Sign in and answer the questions. An account is required. Some templates require a Swedish personal identity number; the builder asks one question at a time and shows the finished text updating as you go.
  2. Look up anything unfamiliar. The questions are in Swedish. Our English glossary of Swedish form terms covers the words the forms actually use, and you can ask us in English at any point while you fill it in.
  3. Pay once, at the end. 420 kr, including VAT, only when the document is finished and you have seen it.
  4. Complete the required formalities. The bank decides for itself whether to accept a power of attorney drawn up elsewhere, and often requires the original, a visit in person, or its own form. Avtalsfrid's ordinary e-signing flow is therefore disabled; print, sign and check the requirements with the bank first.

Being straight about language: this page, the guides and our support are in English. The builder itself and the finished document are in Swedish because that is how this service is currently delivered for use with Swedish counterparties, banks and authorities. That is not a universal rule that every Swedish agreement must be written in Swedish: the accepted language can depend on the document, its form requirements and the recipient. Questions

Will the power of attorney for banking be in Swedish or English?

Our current service produces the finished document in Swedish so Swedish counterparties, banks and authorities can work with it directly. Swedish law does not impose one universal language rule for every power of attorney for banking, and an English agreement or translation is not automatically without legal effect. What is accepted can depend on the document's form requirements, the agreed governing language and the recipient's own requirements. Which law applies to a power of attorney for banking in Sweden?

The Contracts Act, avtalslagen (1915:218), 2 kap. 10, 11, 16 and 21 §§. The template is designed for a Swedish-law situation. Where you live, where property is located and whether another country is involved can affect jurisdiction, recognition and tax, so cross-border cases should be checked individually.

Is it valid if I am not a Swedish citizen?

Citizenship is usually not the deciding factor. This service is for a power of attorney for banking governed by Swedish law and connected to Sweden. Cross-border property, residence, tax or family circumstances can change the analysis, so ask for individual advice if more than one country is involved. You do not need a Swedish personal identity number to create the draft.
